Terms & Conditions


By Confirming A Booking With Pend Logistics Ltd You Are Agreeing To The Following "Terms And Conditions".

 

 

In These Terms The Following Definitions Apply:

 

The Company:    means Pend Logistics Ltd.

(Unless the context precludes the same) includes Pend Logistics Ltd servants, agents and any person or persons carrying goods under the contract with Pend Logistics Ltd.

 

Customer:           means You.

And any person who contracts for the service of Pend Logistics Ltd and includes the Customers servants or agents.

 

General

 

1.           All and any business undertaken, including any advice or information given or service provided whether gratuitously or not is carried out subject to the Conditions below.

 

2.           The Company is not a common carrier and will accept goods for carriage only on these conditions.

 

3.           No agent or person employed by or under contract with the Company has any authority to alter or vary in any way these conditions unless authorised to do so by the Company in writing.

 

4.           All agreements between the Company and its Customer shall be governed by English Law and be within the exclusive jurisdiction of the English Courts.

 

Goods

 

1.           Customers entering into business of any kind with the Company for the carriage of goods expressly guarantee that they are either owners or the authorised agent of the owners of any goods to which the business relates. And further guarantee that they are authorised to accept and are accepting these conditions not only for themselves but also as agents for and on behalf of all other persons who are or may thereafter become interested in the goods.

 

2.           All goods must be properly labeled and prepared.

     If the Customer requires the Company to package and prepare the goods, this will be at a small extra cost subject to the size of the goods, the goods itself and the number of goods requiring packaging.

 

3.           The Company will not accept or deal with any of the following:

  • Noxious Goods
  • Dangerous Goods
  • Hazardous Goods
  • Explosive Goods
  • Stolen Goods

Should the Customer nevertheless deliver any such goods to the Company or cause the Company to handle or deal with any such goods, the Customer shall be liable for all loss or damage whatsoever caused by or in connection with the goods however arising. The Customer shall indemnify the Company against all penalties, claims, damages costs and expenses. The goods may be destroyed or otherwise dealt with at the sole discretion of the Company or by any person in whose custody they may be at the relevant time.

 

4.           Except under special arrangement previously made in writing and agreed by the Company, The following goods may be considered:

  • Bullion
  • Coins
  • Precious Stones
  • Jewellery
  • Valuables
  • Antiques
  • Pictures (excluding commercial artwork)
  • Livestock or Plants
  • Perishable Goods

Should any Customer knowingly or unknowingly cause the Company to handle such goods without special arrangement, the Company shall be under no liability whatsoever in connection with the goods however arising.

 

5.           Upon delivery, a Delivery Note must be signed to accept the Goods and to also accept that the Goods have arrived in good condition. Once this has been signed The Company cannot accept any responsibility the condition of the Goods thereafter.

 

Routes & Freelance Couriers

 

1.           Any instructions or business accepted by the Company may in the absolute discretion of the Company be fulfilled by the Company itself or sub-contracted to a third party.

 

2.           Subject to express instructions given by the Customer, the Company reserves absolute discretion as to the route and procedure to be followed in the carriage, handling, storage and transportation of goods. Further if in the opinion of the Company it is at any stage necessary or desirable in the Customers interest to depart from those instructions the Company shall be at liberty to do so.

 

 

Payment and Cancellations

 

1.           Payment is required as either Cash or Credit /Debit Card via Pay Pal. All payments are to be completed at point of arrival. No funds will be taken before this point unless agreed by both parties at time of booking.

 

2.           All credit accounts are rendered at such periodic intervals as shall be the Company’s policy from time to time and are subject to settlement within 14 days from date of invoice. Where payment is not received by that date any offer made by the Company to give credit or discount for prompt settlement will automatically be deemed to be withdrawn and the Company reserves the right to impose a surcharge on all outstanding balances at the rate of 5% above Bank Of England Base Rate per Week.

 

3.           All sums shown to be due to the Company on its invoices sent to the Customer shall be paid to the Company immediately when due without deductions and payment shall not be withheld or deferred on account of any claim counterclaim or set-off.

 

4.   If a booking is Cancelled within 24 hours of the agreed time, a cancellation fee is payable.

    If a booking is Postponed until a later date within 24 hours of the original agreed time, then a fee is still payable, however this fee will be deducted from the final amount once a new booking is made.

 

 

Insurance Cover

 

1.           The Company shall be responsible for any loss or damage to goods for any non-delivery or mis-delivery if it is proved that the loss, damage, non-delivery or mis-delivery was due to the negligence or default of the Company.

 

2.           The Company has Goods In Transit Cover of £10,000.

Since The Company is unable to assess the cost to a Customer of the loss or damage of any goods, it is advised that the Customer should insure against such risks especially if the goods are valued higher or The Customer would suffer consequential losses. The Company is unable to warrant that its own insurance cover will be applicable to all losses or damages or will extend to cover any sums claimed.

   

The Daisy Chain

All the above Terms & Conditions apply to the Daisy Chain.

The Customer agrees to be placed on a Daisy Chain by acceptance of the booking price and not by enquiring about prices.

Once the Customer has agreed to be placed on a Daisy Chain this is considered as confirmation of a booking.
